Accounts
You are responsible for your login credentials and for all activity under your account.
- Eligibility: You must be at least 13 years old (or the age of digital consent in your province) to use the services. If you are under 18, you represent that you have parental or guardian consent.
- Accurate information: Provide true, current, and complete information during registration and keep it updated.
- Security: Keep your password confidential and notify us immediately of any suspected unauthorized use.
- One person per account: Do not share your account with others or resell access.
Acceptable Use
- No unlawful, harassing, or infringing content.
- No attempts to disrupt or reverse-engineer our services.
- Respect intellectual property and privacy of others.
- No spam, malware, scraping without permission, or automated account creation.
- Do not impersonate others or misrepresent your identity or affiliation.
- Use content and materials only as permitted by these terms or explicit written permission.
Payments and Cancellations
Prices are listed in CAD. Refunds may be available before course start. Taxes may apply based on your province.
- Billing authorization: You authorize us and our payment processors to charge your selected payment method for fees, applicable taxes, and any recurring subscription charges.
- Auto-renewal: If you enroll in a subscription, it will renew automatically at the end of each billing cycle unless canceled before renewal.
- Trial periods: If a trial is offered, charges begin when the trial ends unless you cancel beforehand.
- Refunds: For multi-week courses, a full refund is generally available up to 48 hours before the first session. After a course begins, refunds are prorated or unavailable depending on course type. Subscriptions are non-refundable for the current cycle.
- Chargebacks: Contact us to resolve billing issues before initiating a chargeback. Unauthorized chargebacks may result in account suspension.
- Discounts and coupons: Promotional pricing may have eligibility limits and expiry dates.
Intellectual Property
- Our content: The site, curriculum, recordings, exercises, branding, and other materials are owned by Kunterio Voice Academy or its licensors.
- License to you: We grant a limited, non-exclusive, non-transferable license to access and use the services for personal, non-commercial learning.
- No distribution: Do not copy, record, broadcast, or distribute course content without written permission.
User Content
- You retain ownership of any content you submit (e.g., practice recordings, scripts).
- License to us: You grant us a worldwide, non-exclusive, royalty-free license to host, process, and display your content solely to provide and improve the services.
- Prohibited content: Do not upload content that infringes rights or violates law.
Privacy
We collect and process personal information to operate and improve the services, consistent with applicable Canadian privacy laws. Review our Privacy Policy for details on data categories, purposes, and your rights.
Disclaimers
Training outcomes depend on individual practice and engagement. We provide educational guidance without guarantees of employment.
- The services are provided “as is” and “as available” without warranties of any kind, express or implied.
- We do not warrant uninterrupted or error-free operation or that content will meet your expectations.
Limitation of Liability
- To the maximum extent permitted by law, Kunterio Voice Academy is not liable for indirect, incidental, special, consequential, or punitive damages.
- Our total liability arising out of or relating to the services is limited to the greater of CAD $100 or the amounts you paid to us for the services in the 12 months preceding the claim.
Indemnity
You agree to defend, indemnify, and hold harmless Kunterio Voice Academy and its instructors from any claims, damages, liabilities, and expenses (including legal fees) arising from your use of the services or violation of these terms.
Termination
- We may suspend or terminate access for any breach of these terms or for conduct that risks harm to our community.
- Upon termination, your right to access the services ceases immediately, but provisions intended to survive (e.g., IP, payments, disclaimers, limitations) will continue.
Changes to the Services or Terms
- We may modify the services, courses, or pricing to improve quality or reflect market conditions.
- We may update these terms from time to time. Continued use constitutes acceptance of the updated terms.
Governing Law and Dispute Resolution
- Governing law: Province of Ontario and federal laws of Canada, without regard to conflict of laws principles.
- Venue: Courts and, where applicable, arbitration seated in Toronto, Ontario.
- Informal resolution: Contact us to attempt to resolve disputes informally before formal proceedings.
- Class action waiver: Disputes must be brought in your and our individual capacities, not as a class or representative action, where permitted by law.
